UK Resident Card Holder Travelling to Portugal with Spouse

Post by EllieP85 » Tue Jun 21, 2016 1:52 pm

Hi All

I have been trying to establish whether or not my husband requires a Schengen visa to travel to Portugal with me?
The rules are very confusing and if anyone could shed any light I would be so appreciative.
He is South African but holds a UK residents card and we are married. I am a UK citizen.
If we are travelling to Portugal together does this mean we don't need to get him a visa?

Please could you let me know asap as we are due to fly in early July.

Thanks

Trying to establish where your topic belongs, can you tell us if he is on a spouse settlement visa or if he joined you via a period of you living/working in another EU state and returning to the UK via the Surinder Singh route?

What does he residence card say exactly?

Hi

He is on a spouse settlement visa, we have only lived in UK.
His card says Spouse/Partner Leave to Remain.

Does that help?

Thanks

I have moved your topic to the appropriate sub-forum.

Yes, as a Saffa, he will need a Schengen visa to board the plane and enter Portugal.

Should be free, but if your marriage cert is not apostilled by SA Home Affairs, he will likely have to pay the visa fee. You might be running out of time if you are traveling soon as the turnaround for visas is 10-15 days.

If he needs a visa to enter Portugal as a SA citizen he will continue to need one until he has BC. He will need to apply for a Schengen visa, but you're cutting it a bit fine for travel at the beginning of next month.
