Claiming benefits

Post by Wakizashi21 » Wed Jun 22, 2016 10:26 am

Hi All,

My wife is currently on a spouse visa (i am british and we have a child who is british....with one more due in December)

My wife is on the 5year visa route and her visa is set to be renewed in jan 17.

I have been told by many that i cannot claim any sort of benefit.

Currently i only claim Child Benefit which works at around £20pw.

I have a property so i understand not being able to get a council property.

Can anyone tell me if i am entitled to any benefits myself without effecting the spouse visa?

Im looking at Child tax credit, working tax credit and any other benefit as im currently earjing £18600

Is there a list of permitted/not permitted benefits?

No problem if you claim WTC and CTC in JOINT NAMES. Child benefit in your name only. Housing benefit can only be awarded as a single person with a child. Your wife can't be included in the calculation.

Tax credits MUST be claimed in JOINT names with your spouse. This will not affect her visa.

The benefit calcluator below should give an idea of what you can claim.

http://benefits-calculator.turn2us.org.uk/AboutYou

Housing benefit, if you qualify, cannot include your spouse as an applicant, i.e. 2 adults, 2(3) children. It must be 1 adult, 2(3) children.

Thank you voth for your response.

So that means i can claim child tax credit and working tax credit and this will not effect her visa renewal in jan 2017?

Slightly worried as i havnt claimed anything since 2014 due to the fear of having her visa rejected.

No it won't. If you search the forum you'll find that this has been advised many times.
