10 years in Uk, married for 3 years. when to apply 4 BC

Post by teryor77 » Mon Jun 27, 2016 10:38 am

Hello ,

please i need help here conserning my naturalisation, i have lived legally in the UK for over 10 years (December 2005), i got married to a BC March 2013.

i applied and got ILR 04/01/2016.

please when can i apply for naturalisation , now or wait till Jan 2017?

i read somewhere that if married one can apply for naturalisation immediately after ILR as long as the person has been living in uk for 3 years prior to naturalisation application.

please can someone shed more light on this by suggesting when i can apply

Yes you can apply now here are the requirements for (to become a British citizen)

2. If your spouse is a British citizen
If you’re married to, or the civil partner of, a British citizen, you can apply for citizenship if:

you’re 18 or over
you’re of sound mind, eg you’re able to think and make decisions for yourself
you’re of good character, eg you don’t have a serious or recent criminal record
you’ve met the knowledge of English and life in the UK requirements
you’ve been granted indefinite leave to stay in the UK (this means there’s no specific date that you have to leave) or permanent residence if you’re an EEA national (and you have a permanent residence card or document that shows you have permanent residence)
you meet the residency requirement
Unless your spouse or civil partner works abroad either for the UK government or for an organisation closely linked to government, you must usually also have:

lived in the UK for at least the 3 years before your application is received
spent no more than 270 days outside the UK in those 3 years
spent no more than 90 days outside the UK in the last 12 months
not broken any immigration laws while in the UK
Read the guidance notes and the requirements booklet before applying.

Thank you for prompt respond Jehan

i have another question please.

i have just applied for my sons ILR (SET(F)(he is 15 years old), i have not gotten a response yet from home office as they requested for more documents to show we are related..

can i apply now for naturalisation considering my sons application is in HO or do i wait till adecision is made on his application, my son has been here legally for 8 years and has always been my dependant.

are there any implications if we apply for BC seperately ?

Your son's ILR application and your naturalisation application are two completely separate applications and process and two completely different departments.
