Questions before NCS appointment. Please answer.

Post by IndiMarshall » Wed Jun 29, 2016 9:12 am

Hi,
My spouse who is in UK is applying for Naturalization. She meets all criteria to apply for Naturalization. I am a Naturalized British citizen. I have few questions which needs answers. Geographically I am far way to ask these to my friends and with limited access to Internet. The last I had been in touch with this process is couple of years ago, lost touch with many terms so am seeking help. I just want to be very sure when my wife goes to her NCS appointment as slots are very hard to get these days. Questions seem long but all straight forward answers, I kept them elaborative.

Questions.
Refernce

1) When I applied for citizenship, for professional reference I took it from my friend who is a software contractor and he has his own limited company and he was the director of that company. The then link
https://www.gov.im/media/624353/listofreferees.pdf stated that Referee can be ‘ Chairman/ Director of limited company’ . It worked out fine for me.
Now according to the referee link I found here in the sticky thread of Jambo.
https://www.gov.uk/government/uploads/s ... ersons.pdf it also says same. Can I go ahead with a similar process of having the sign from my friend who is software contractor and has own limited company and director for it.

Certificate reference number.

2) In section 1.35 of Naturalization application there is a question to enter Citizenship certificate reference number.
In the citizenship application it has 2 details as Certificate number and Reference number, which one do we need to enter? I am assuming the Reference number (alphanumeric one). Please confirm.

Address of partner and proof

3) I am not residing in UK for last 14 months. In a column in her application there is a question for partner address. Let me know if I have to give my Indian address where I am living now or can I provide my UK address where I lived with her when I last left UK . I intend to travel back to UK in next few months.
Also if she takes my original naturalization certificate is it fine ? My passport is with me and I am in India.

How to travel outside UK after NCS appointment -

4)
Please verify the section 6 in Naturalization form -
https://www.gov.uk/government/uploads/s ... 1-2016.pdf
Its been mentioned like below -
“If you have a current grant of leave on a biometric residence permit (BRP), you must provide your BRP for the application to be valid and complete. “
Queston: I believe BRP is the permanent resident card.
Is it mandatory to submit BRP card during NCS appointment? Its been mentioned in 6.11 that we can either submit with in 5 days of granting citizenship.
All I want to make sure is she should be free to travel outside UK after her NCS appointment and until the ceremony. Please let me know how can this be achieved.

Thanks.
Indy

1. Yes, as long as your 'friend' has actually known your wife for 3 years.

2. It is the CERTIFICATE NUMBER.

3. Your current address. Naturalisation certificate is fine.

4. No, NCS will copy it and return the original to your spouse.

Question...

Did you see any delay in applications due to result of Brexit ?? I understand that each application is unique but in general did you see the the timelines increase after BREXIT result ??

No. UK Nationality Laws have nothing to do with Brexit/EU rules.

I see.. when I applied for HSMP extension.. in 2012 it took me forever as the team that was supposed to work on HSMP extension was moved to approve visas for Athletes who were attending the Olympics in London then..

Another time.. I applied for my British citizenship and it took me forever again ...the reason they cited was the BC application team was moved to approve the huge Passport applications that come in during the period of July and Aug due to school holidays.

Likewise I assumed many Europeans would be applying for a PR as of now and then BC or something that would surge the applications , may be this might prompt BC Application team to deal with these surge in applications in other teams... That was my assumption.

Any insight ?

EU PR and Nationality are two different departments. Your assumption is likely incorrect. Brexit does not affect UK immigration or nationality applications.

Although Brexit seems to be blamed for everything else going on in the EU at present.

Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
