Tier 1 (Entrepreneur) Effective Date

Post by Nitch » Thu Jun 30, 2016 12:34 pm

Hi All,

I am currently on a Tier 2 (General) visa. My plan is to apply for a Tier 1 (Entrepreneur) visa, and once it is approved, give the 30 days notice to my current employer.
Will it be possible to have the Tier 1 visa come into effect later than the time it is approved, 30is days after in this case?

Thanks,
Nitch

No, it is dated and valid from the date the visa is granted/approved.

Thank you!

This creates quite the conundrum, as I would like to give a 30 days notice, however I don't want to take the risk of resigning before my application is approved.
I won't be at a legal risk if I resign due to visa change as my contract covers this option, but I wanted to be professional about it and give them the full notice.

Any ideas or workarounds?

Thanks,
Liad

On Tier 2, you can apply to switch within 60 days from your last employment without having your continuous period broken. It is quite risky to apply to switch to Tier 1E while being employed on Tier 2 general. You need to choose one, either accept the risk, resign and apply for Tier 1E or simply stay on Tier 2.
