Working Abroad and Visiting Home (UK)

Post by ahmed87 » Sat Jul 02, 2016 9:18 pm

Hi All,

I am a UK citizen. I never intended to get married abroad, however I found a spouse recently when visiting my family abroad :). I would like to apply for her to come to the UK (Sept-16) and do not think I will have an issue with the application process for the "family of a settled person visa".

I have always wanted to work abroad which I plan to do after she arrives here (May-17). I do plan to eventually return to the UK permanently, however in the mean time I will come to the UK for family visits, medical checks etc...

My Question is if I take my wife with me abroad after she comes to the UK with her visa and she exceeds the 90 or 180 day rule will she not be allowed to enter the UK when we come back for family visits / medical checks? Will she have to apply again when we are abroad? or will we have to apply for a "family of a settled person visa" again from her country of residence?

Has anyone been in this circumstance or is aware of what happens when a spouse travels abroad with her spouse for a long period over a year i.e. only returns to the UK twice a year for a few weeks.

Kind Regards

she exceeds the 90 or 180 day rule
Why do you think there is such a rule?
however in the mean time I will come to the UK for ............. medical checks etc...
You shouldn't be using the NHS in this way if you are not residing in the UK. This is what they call 'health tourism'. You are not ordinarily resident and will likely have to pay for any medical checks/meds/tests etc. See NHS - Moving Abroad (click). See also Returning from Abroad (click)

Why go through the very expensive spouse visa process if you are not going to live and settle in the UK? You are clearly not going to be 'settled' in the UK.

As I have read it on a few forums. So if my spouse is on the 33 month visa and she spends most of the time out of the country, will the visa be void? I'm just worried they will not let her back in.

I wasn't aware of the NHS rules, thanks for sending me the link. After paying tax's for 10 years and being a UK citizen I assumed I could continue getting free health care. One must respect the rules and thanks for sending me the information, I will ensure sure whoever I work for will have medical cover.

What other visa options are there? As the standard visa option is 6 months and the fiance visa is for 6
