PR (financial dependancy on my mom) & Naturalisation

Hello

I acquired my Permanent Residence (sea route) at the beginning of year 2016. My application was based on the ground that my mother is a sponsor to me because i did not have CSI while I was a student. I was financially dependant on my mother even though I was already well over the age of 21.

My question: at the beginning of year 2017 I am planning to apply for a British Citizenship (Naturalisation application). I was wondering if the HO may raise questions again regarding my financial dependancy on my mother or it will be enough if I just submit my PR card. I read the guide and I understand I still need to submit the evidence of 5 years in the UK (employment / studying).

Could please someone clarify this?

My second question: is it possible to find out the date when I acquired my PR? The card only says when it was issued but it does not really say when I acquired it.

I heard that If i go to Nationality Checking Service, they could find out this information on my behalf. Is that right?

Yes, they should be able to contact HO to get the date.

Your dependency on your mother is irrelevant to your citizenship application.

When I gather my documents for the submission:

I need to send my PR card, last three bank statements, Life in the UK Test, my UK degree (Bachelors) which does not have to be approved by NARIC as i studied here in England and obviously in English!, do I need to submit again my proof of address for 6 years or any other documents proving that I have been in the UK for 6 years or it is entirely enough with my PR card. ?

You need to submit your PR card, LIUK, English Degree, passports, photos and form. Follow exactly what the form asks, don't over think it and don't send unnecessary documents. By all means take docs with you to NCS, but they will only take and submit what is required.

HO is unlikely to question your 'dependency' as you are applying for citizenship in your own right and only you have to meet the requirements. Non-dependency or being in employment is not a per-requisite for citizenship.

I understand NCS will submit my application on my behalf, but I am thinking of going to discuss with them and check my application form with my supporting docs and also to find out when I actually acquired the PR if they contact the HO. Then after my appointment with NCS, I will submit my application myself.

As regards to my dependancy, HO will see on what basis I acquired my PR but hopefully as you say they will unlikely question anything.

i guess apart from my PR I won't need to submit any other docs regarding the 5-6 year acquired period but I will find this out when I have my appointment with NCS.

The whole point of NCS is that they check and submit the application on your behalf so that you get to keep hold of all your original documents, including your passport. I would strongly suggest you use the full NCS service, as this is what you are paying them for, and not post your stuff off on your own. You can also apply for the joint citizenship and passport application through NCS, which is not available if you apply on your own.

If you wait for 12 months from date of PR, then you don't need the date you acquired PR. The 12 month wait will be sufficient to meet the requirement.

Thank you for the advice! Yes but I would rather not wait those 12 months, i am only considering to wait because the PR card does not state when I acquired it. Hmmm

How long have you and your mother been in the UK and how long has she been exercising treaty rights?

My mom is a British citizen, she received her passport few months ago. She has been in the UK since 2007 and always worked. I have been in the UK since 2009 but did not work in the beginning. I opened my bank account in autumn and when I applied for my PR through my mom, I submitted my bank statements dated autumn 2009, hopefully thats when i acquired my PR? Then in 2010 I started studying, and started working part time in 2012. I never had CSI and therefore acquired my PR through my mom as my sponsor financially. I received my PR at the beginning of this year.

It's important to confirm that you had PR before your mother was granted British Citizenship.

As your mother is now a BC/dual national in order to benefit from the transitional agreement you will have to prove you have been exercising treaty rights in the UK for 5 years in order to obtain PR. (Case C-434/09 McCarthy). She can no longer be your EEA sponsor.

Casa - I acquired my PR and received it few months ago. And I received my PR while my mom was not a British Citizen, she became British citizen after I got my PR.
