Spousal Visa Process for ILR 10 Year Main Applicant?

Spousal Visa Process for ILR 10 Year Main Applicant?

Hi All,

Was hoping for a little advice.

My husband will be eligible for ILR through 10 Year long residence in a few months. I recently received my Tier 2 Dependant visa earlier this year, and it is still good for the upcoming 2 years.

I read that since he's applying for the ILR through 10 Year, I will have to switch my visa to a spousal visa, instead of keeping the PBS visa. Can someone confirm if this is true?

Also, if it is true, when do I apply for my spousal visa? Do I apply for it at the same time as his ILR visa (since I don't qualify for my own ILR) or do I wait until he is approved, then apply immediately afterwards?

Any advice would be greatly appreciated.

Yes, it is true and this will reset your clock to zero. You will need 5 years on a spouse visa (FLR(M) x 2) before you can apply for ILR.

Also slightly off-topic question (as I've seen differing answers already on this).

For my husband's ILR application, I know you can apply up at least 28 days prior to the 10 year date. However, does that date begin on the time his first visa is eligible for or the date he entered the UK on his first visa?
