Six months after ILR

Post by User001 » Fri Jul 08, 2016 11:28 pm

Hi everyone,

Just wanted clarification. I was told by a lawyer that it is possible to apply for BC 6 months after obtaining ILR but he did not mention how. I guess so I would go back and get charged again. does anyone know of this ?

thank you

If you are married to a British citizen there is no requirement to wait after obtaining ILR before applying for naturalisation.

If you are not married to a British citizen, you must wait 12 months before applying.

Thanks Ohara,

I do not think the lawyer was referring to this. maybe he was talking about discretionary application

There's nothing in any guidance or HO documents that I have ever seen which says you can apply after only 6 months. The requirement clearly states:
You must be free from immigration time restrictions when you apply for naturalisation. Unless you are married to or the civil partner of a British citizen, you should have been free from immigration time restrictions during the last 12 months of the residential qualifying period.

An application is discretionary already.

How long did it take for your ILR application to be processed?
