10 years ILR calculation

Post by kmzan » Sun Jul 10, 2016 4:43 pm

Dear Sir/Madam,

I am writing this email to get some specific information about indefinite leave to remain under the long residence.

My entry clearance to UK from Bangladesh was issued on 20/09/2006. I arrived to UK on 09/10/2006. Finally, now my current visa expires on 03/10/2016.

Could you please clarify the following two questions
1 According to the above dates, will I qualify for the indefinite leave to remain under the long residence? (To my understanding of the guidance notes on the GOV.UK website, my qualifying period starts from the visa issue date 20/09/2006. Which means I should qualify for the total 10 years needed.
However, if the date of entry 08/10/2006 is taken into consideration, then will I be still qualified for the total 10 years assuming that I will be applying within 28 days of the current visa expiry). Or i have to apply for another visa for 5 days to be consider my 10 years in uk.
2 Which is the earliest date I could apply for indefinite leave to remain? (Considering 28 days)
Is it 23/08/2016, considering qualifying start date as my first visa issue date 20/09/2006
or
Is it 11/09/2016, considering qualifying start date as my date of entry 09/10/2006

Please do not hesitate to contact me if you need any further information,

Kind regards

K Noman

1. For Long Residence ILR, it is the date of ENTRY that starts your clock towards 10 years LR ILR. You can apply within 28 days of reaching 10 years from date of entry.

2. 11/09 onwards.

Thank you. So i do not need to apply for another 5 days for a visa. Just apply ILR after 11/9/16.

yes, anytime within 28 days. It does not have to be on the 28th day. Suggest apply maybe on 13th or 14th, just to be sure you are within the timeframe.
