Residency Visa

Post by Shabb1234 » Fri Jul 15, 2016 6:46 pm

Hy, I applied for Tier 1 , dependent visa back on 2014 and received UK visa of 1.5 years which expired 3 months back. I applied for my first visa extension and this time i got 2.5 years.

My question is if I travel, how long can I stay in other country and that doesn't affect my next visa application? And if I apply for resident visa next time, am i going to get that easily. I am living in UK with my husband(he have his long residency visa) and my baby(British citizen).

If you have a visa now for 2.5 years, have you applied for FLR(M) spouse visa?

Traveling is fine, but absence should be limited and for good reason, i.e. you shouldn't live in another country and only occasionally visit the UK. When it is time to apply for ILR, you have to declare all absences that are 6 months or more.

I recently received my visa extension. And haven't applied for FLR(M) spouse visa, neither i have any idea about that. Is it compulsive to apply for FLR (M) ?

So it's okay if I stay 3-4 months in other country that will be less than specific criteria of 6 months.

If you don't have FLR(M), what visa do you have? :?

If your husband got his ILR based on 10 years long residency, you really need to check what visa you currently have. You are at risk of being refused entry if you still have a Tier 1 Dep visa as this is no longer valid. You should apply, if you haven't already, for a spouse settlement visa on FLR(M) BEFORE you travel.

Hi,
I checked it, and yes I got FLR (M) visa. Sorry for that, before had misunderstanding.
So, can I travel and stay in other country for 3-4 months? Not affecting my next extension visa ?

Yes, you can travel but make sure you return before your current visa expires.
