Tier 2 PBS dependant visa extension post April 2016

Post by bipink » Tue Jul 19, 2016 4:42 pm

Hi,

Situation:

My wife was in Tier 2 general category visa in the UK.
She got the ILR (PR) last year. So, Tier 2 general to ILR.
I was on Tier 2 PBS dependant visa since last 3 years and its due to expire soon.

Questions

1. As my wife is on ILR, am I only eligible to extend my visa as IRL dependant?
2. If I do so, will my PR eligiblity will be reset and I need to start counting again from 0 instead of 3 as I change from PBS dependant to ILR dependant?
3. What are the minimum set of documents we need to produce (post April 2016) for my visa extension in the right category which I am eligble for?

Hope someone can answer my questions soon.

Thanks,
Bip

1. You can continue to extend your PBS Dep visa until you meet the requirements for ILR.

2. Switching to ILR Dep (actually called spouse settlement visa) will reset your clock to zero. This switch on FLR(M) is ONLY mandatory if your spouse got ILR based on 10 years long residence.

3. Read the PBS Dep guidance notes and search the forum.

Hello, Thanks for that.

Can you also help me to find the link to the latest application for extending PBS Dep visa as well?
Unfortunatley, I could only find the below which is for FLR(M) and nothing else for extending stay in the UK as PBS dependant.
https://www.gov.uk/government/publicati ... -form-flrm

Can you spot that.

Sorry I found it please confirm this one is right:
https://www.gov.uk/government/publicati ... rs-1-2-4-5

Also can you tell me where to find that clause on the uk gov site which referes to "Switching to ILR Dep (actually called spouse settlement visa) will reset your clock to zero. This switch on FLR(M) is ONLY mandatory if your spouse got ILR based on 10 years long residence."

Thanks a lot.

It's a consequence of E-ILRP.1.3.
