Hello Every one

I've a query regarding my new born baby Visa, Currently I'm on Tier 2 General visa and in July first week got my extension for tier 2 , Now my family is going back to Pakistan in August

I know that if I apply for his visa ( Tier 2 Dependent ) from here then my baby will be eligible for MNA1 form ( to apply for British nationality certificate ) and after that he will be eligible for Nationality after when i get ILR? is this correct


My family have no plan to visit again Uk for at least next 9 months,
so if they apply from the home country for tier 2 dependent visa , Then my baby is still eligible for MNA1 ( to apply for British nationality certificate ) and after that he will be eligible for Nationality after when i get ILR? is this correct,


If i apply from here then i need to apply for premium service because my family need to travel to Pakistan in the second week of the August. so it cost me almost 1164 + 600( Health Surcharge ) so total = 1764
but if i apply for his visa from Pakistan then total cost = 575 + 500( health surcharge )= 1075

so if there is no impact on his future then I'll prefer to apply from the home country , any help in this regard much appreciated.

Having a valid visa, regardless of where you apply for it, has nothing to do with a UK born child's entitlement to register as British on form MN1 once either parent obtains ILR. A visa is required to re-enter the UK. If the child does not travel out of the UK, no real need for a visa.

Thanks CR001 for your prompt response as usual.

one last question , will 5 year continuous residency rule apply for my dependent as well ( wife and daughter ) who are currently on my Dependent visa from June 2015 till now ,

if they have a valid visa and they stay outside uk more than 6 months in a year then its ok , because due to some family issue and we have a baby my wife want to spend first 10 months in Pakistan , after that period they will be living with me continuously. is there any issue for them when they apply for there ILR in June 2020
( I'm eligible for ILR in October 2018)

leave UK 31 December 2015
Re enter UK 27 March 2016

Yes, they will require 5 years residence as PBS dependents.

Absence should not be a problem but maintain evidence of communication and subsisting marriage.

you can delay applying for your son's dependent visa in pakistan as well.. you'd get to save £100 for every 6 months u delay..
so if they are not coming back for another 9 months, suggest u apply after 6 months and u will get to save 100 on ihs charges.

That what i was calculating , and want save some money :-)

Apply in Uk charges = 1164 + 600( Health Surcharge ) so total = 1764

so it almost save me 680£
