SET (M) or FLR (M)

Post by david2014 » Mon Jul 25, 2016 11:46 am

Hi everyone!

Could someone advise which route to choose FLR (M) or SET (M).

I came to the UK on a marriage visa in September 2011. Soon after the wedding I applied for and was granted 2 year FLR (M) in February 2012. Although I seemed to be eligible to apply for SET (M) in 2014 I decided to apply for and was granted extension of LR in Aug 2014 for 2 years. The reason was that for professional reasons I stayed more than 6 months (7 months to be precise) outside the UK. Now my LR runs out on 22 Aug 2016. For the past 2 years I've been only absent for a bit more than 2 months and took another 2 very short trips abroad. I've passed Life in the UK test few months ago and IELTS test in April 2014. Both of us are fully employed, no dependants.

Thank you!

I got a bit confused reading this forum because some people mentioned that in some cases an applicant has to apply again for 2.5 years extension of LR to complete 5 years residency.

Another question. Does my wife have to come with me for PEO appointment? She's got a tight schedule at work and it might be very difficult for her to come. When we first applied for FLR (M) my PEO appointment lasted almost 6 hours.

You fall under the old, pre 9 July 2012 rules, so 2 years residence.

Yes, your BC/ILR spouse should attend with you. If she can't, she will have to write a letter and explain why she can't and also to support your application.

If your wife is unable to attend the PSC appointment with you she will have to submit a letter explaining the reason for her absence.

Thanks a lot!

Also. When I did my last application I enclosed a letter explaining the time I was absent ( from Jan 2013 to Aug 2013). Do you think I should write a letter explaining my absence for this application too? I kept a copy of that letter.

It may not be required, but would be worth including.

Thank you vinny, Casa and CR001!
Another question. The form requires me to provide SELT unique electronic reference number. I took IELTS in 2014 and there's no such number in my certificate. Where can I find it? Or should I just leave it blank?

They have scaled back on the test providers that are approved.

Is the English test level B1?

Well, I scored 8.5. It seems to be equivalent to C1 which is higher than B1. I just can't see where to find this number.

The SELT providers came into effect last year when HO overalled the test providers list, hence why your test needs to be on the current list. Tests prior to April 2014 will not have this number.

Could I still use my 2014 IELTS certificate for the current application or do I have to sit another test? It is valid until April 2016 but I've read that HO will accept it if it was used in my previous application.

I think I've found the answer here http://www.immigrationboards.com/indefi ... 50671.html
But I am a bit concern this information could be outdated since the thread is from 2011.

I've looked at older threads and it seems that they no longer accept Academic IELTS (the one I took) even if it was accepted for FRL (M) approved in Aug 2014, but specifically require IELTS for UKVI fromIELTS SELT Consortium. Could someone confirm?

To be sure, or be even more confused, see also Appendix KoLL and Appendix O and Caseworker's Instructions, etc.

Spouse's name in the form

Post by david2014 » Sun Aug 07, 2016 7:00 pm

Hi,
I'm applying for ILR using SET (M). I'm not sure weather to put my wife's maiden name or the surname she's using now. She's British and the surname in her passport is her maiden name but in her driving license, bank statements, payslips, etc she uses my family name. Does anyone know what name I should put in 2A under "your partner's name".

I've taken Trinity College test and received the certificate. My appointment is tomorrow morning in Croydon.

Put married name in the 'Partners Full Name' section and put maiden name in the 'Name at birth if different and/or any other names by which he/she is or has been known'. Obviously you are submitting your marriage cert.

I had my appointment on Monday and my application was approved. I came there at 8:15 and was prepared to wait for hours. But, surprisingly, it only took an hour and a half.
Thank you all for your help.

Congratulations David, it will be really helpful if you can please share what all documents/information you provided in support of your application.

As you initially came into UK before 2012 did you have to provide minimum income proof as well with your SET M application which just got approved please?

Thank you

Only adequate maintenance will have needed to be provided as visa originally granted pre July 2012. Minimum income evidence would not have been necessary.

Thank you
