ILR Dependent

Post by madison81 » Thu Jun 02, 2016 6:08 pm

Hi,
i am on ILR 10 yr route (granted August 2015). Previously, I was on Tier 1 General. My wife was my dependent then and her Tier 1 dependent visa expires in August 2016.

What route should she take? What form should she fill?
We recently had a baby boy who was born in UK, but my wife is on maternity since January 2016. Would this affect the application ? (in terms of financial status, maintenance, income, etc).

My wife entered UK in May 2007. Can she apply for ILR 10 year route in May 2017?

any advice would be really appreciated. thanks
M

No it should not. Do you work? Is your income at least £18,600pa? Does your wife have a degree and NARIC ELA letter or has she done English A1? Your child is automatically British, you can apply for a British passport directly.

My wife entered UK in May 2007. Can she apply for ILR 10 year route in May 2017? Yes, if she meets all the standard requirements, she can apply for ILR based on 10 years long residence.

any advice would be really appreciated. thanks

Section 13 - documents
https://www.gov.uk/government/uploads/s ... _04-16.pdf

If your income alone meets the £18,600 p.a minimum, your wife isn't required to submit evidence of her earnings.

Hi,
with regards to the cohabitation documents, i do not have 4 items on joint names.
and also, if i am applying in August 2016 for my wife's FLR M, i have to provide cohabitation documents for the last 2 years, i dont have enough documents for 2014,
i only have the following

my wife's p60,
my wife's driving license
joint bank statement
my wife's letter from her private pension
i can provide letters and correspondence on my name for 2014

i have lots of documents going back to 2007 which prove that me and my wife lived together but just for 2014, i am struggling. i have enough documents for 2015 and 2016.
and also, in terms of having an even spread of documents in the last 2 years, when they say 6 items each, do they mean

bank statement (one for each quarter) = 1 item ??
letter from NHS (only 1 in an year) = 1 item?

how does that work? because you won't get all the letters regularly, e.g. council tax, letters from nhs, driving license, etc.. how do i spread an item which i got only once in an year??
can anyone please help?? thanks

FLR (M) or SET (M)

Post by madison81 » Mon Jul 25, 2016 7:37 pm

Hi,
My wife entered this country as a student dependent in May 2007.
I got PSW and then Tier 1. I got my ILR in August 2015.

Does she need to apply through FLR (M) or SET (M) ? I am confused. Also, for cohabitation, below is my query

I am struggling with this particular requirement, even though, my wife has been in this country for 9 years.
The requirement is of providing cohabitation documentation in joint names - 4 in joint + 2 individual OR 6 individual items each.

I am planning to apply by the end of July 2016. This means, I have to prove cohabitation from July 2014 to July 2016.

I have the following documents:

1- Bank Statements [Joint Name] - Spread across July 2014 - July 2016
2 - Wife Driving License - 26th June 2014
3 - Wife P60 [2013,2014, 2015 and 2016]
4 - Water Bill - [Joint Name] - [Statement Date is 24th March 2015]
5 - Water Bill - [Joint Name] - [Statement Date is 30th October 2015]
6 - Water Bill - [Joint Name] - [Statement Date is 1st April 2016]
7 - Private Pension letter [Wife] - June 2014
8 - Private Pension Statement [Wife] - October 2014
9 - Letter from Employer - [June 2014]

From 2015 onwards, I have water bill (as above), bank statements,, p 60, letters from council, NHS, mortgage offer letter on joint name, etc..

For me, I can provide documents at similar dates as most of the bills are on my name.
But my questions are as follows:

- I am struggling for the period of July 2014 - March 2015 where I don't have enough documents for my wife except bank statements (joint), pension letter (wife's name). the driving license is as of june 2014 and the letter from employer is dated june 2014. How do I cover this up? I have enough documents to prove that we both have lived together since May 2007 till date, but it is only this critical period in 2014 where I am struggling. Any suggestions?
- When they say you have to spread the documents evenly, what does that mean? how many documents each for every point in the spread?
e.g. if i have to spread it at every 4 months, should the document list look like below?

July 2014 - 6 items for wife + 6 items for me
November 2014 - 6 items for wife + 6 items for me
March 2015 - 6 itemes for wife + 6 items for me
July 2015 - 6 items for wife + 6 items for me
November 2015 - 6 items for wife + 6 items for me
March 2016 - 6 itemes for wife + 6 items for me
July 2015 - 6 items for wife + 6 items for me

is this how they want the documents? please help me out here.
any advice or suggestions would be really really helpful.

thanks
M

FLR(M) is for the spouse visa.

Set(M) is for ILR, she doesn't qualify for ILR.
