MN1 application- Born abroad daughter

Post by choice22 » Tue Jul 26, 2016 11:18 pm

Hi Everyone

I would like to ask a question about my daughter, she was born abroad and her age is 3 and half years old. She has been living in the UK for 3 years and now she is the dependent on my wife's spouse visa. I am a British Citizen which was acquired last year in 2015. I have a son who was born in the UK is also British. When my daughter was born abroad, I was not British. Would any one kindly advice me if I can register my daughter as a British citizen under section 3(1) or section 3(5). As both my wife and daughter do not have ILR yet. I will be grateful of your kind advice.

Thanks

She doesn't qualify for section 3(5) because you are not British by descent.

The simplest and less troublesome route is for her to get ILR with your spouse. High chance of her application being refused because your wife does not also have ILR yet.
