Urgent please!! Info/Help needed!!

Post by damnmad » Sat Jul 30, 2016 8:44 am

Hi respected gurus and members,

I seek your guidance or answers to my questions please:

I am on T-2 G VISA (extended 3 months back for 3 more years) with SOC 2135(Systems Analyst
- worked on same title for 3 years 3 months for same company)

Due to some unforeseen circumstances, I have to switch employer now,
so my question is can i switch to 2136? (as a developer?)

Though my current job title says it as Systems Analyst, the Summary of job description provided by our company
as and for designing and
developing databases and enquiry tools to enable users
to interrogate the information that we hold, and this is the
scope of activity required for this role.
Would that be a problem?

Has anyone faced this situation, please help me out, because this is a matter of URGENCY for me

Thanks & Regards.
Never mind!!!

As long as your new employer has conducted RLMT as per defined process and was not able to find a settled person for that job and you fit their profile based on your work-experience, I don't see a reason why you cannot switch into a new SOC code.

I'm assuming your are paid the appropriate salary as defined by the SOC guidance.

Further to my first question,

Can i re use that IHS reference number again for my employer switching application I'm going to make? (coz i went for successful extension in April 2016 - paid £1200 for 3 years - me and dependant)

or

do i need to pay IHS surcharge again for my visa application again? (for 2 years 10 months)

in this case I get full £1200 refund?
Never mind!!!

You have to pay IHS with each application you make and use a new reference number.

Let us know about the refund, but I suspect you won't get one.

The gov.uk page about refunds doesn't mention this sort of switching after a grant of leave. It does mention those who do not stay for the full period they have been granted, in the context of leaving the UK early. In that scenario there is no refund.

UKVI might treat switching in the same way as they do early leavers - you are choosing to give up what you have already paid for and are making a new "purchase".
