Tier 2 licence Suspended. Need help!!!!

Post by Ppihu » Sun Jul 31, 2016 12:18 pm

Hello,
I got to know from my employer in the month of June'16 that the licence has being suspended by UKBA. And he confirmed me that if curtailment starts then the home office will issue letter for it. Till now I haven't received any letter. Now few days back my employer confirmed that they will take the case to the court so curtailment will not start.
And even didn't issued my salary. I am quite worried regarding my status. So could you help me with my queries:
1. How could get to know the exact status regarding my visa.
2. If I haven't received letter then how could I come to know that when did my curtailment will start.
3. As I haven't received my salary so is their any action I can take against my employer.
4. If in the meantime my partner get new sponsor but visa can be issued from our home country so is it ok I travel to my home country during this period.

Please if I could get any help so that I can take actions according to it. Looking forward to hear from you all.

Kind Regards.

1. How could get to know the exact status regarding my visa.
When and if HO writes to you.
2. If I haven't received letter then how could I come to know that when did my curtailment will start.
It will start on the date of the curtailment letter, if and when you receive it.
3. As I haven't received my salary so is their any action I can take against my employer.
Your employer still has to pay you. Suggest speak to your manager/HR or ACAS (click) or CAB. If they are an HO sponsor, they should know the rules. Is it a genuine sponsor or an umbrella company or similar?
4. If in the meantime my partner get new sponsor but visa can be issued from our home country so is it ok I travel to my home country during this period.
Yes, but you might struggle to re-enter the UK. You can switch to PBS Dep within the UK if your partner gets a Tier 2 General.

Many Thanks for your kind response.

And I have also got some more queries which are as follows:
1. Is their any difference between sponsorship being suspended and revoked?
2. As The company confirmed that their licence is being revoked and they are filling the case in court? So, is it safe to continue to stay with the company or switch from it.

Looking forward for your reply.

Kind Regards.

Suspend = temporarily prevent from continuing or being in force or effect.

Revoke = officially cancel
(Casa, not CR001)
