Hi

I am on ILR and i want to apply a visa(first time) for my wife who is in India. Can some one advise me what type of application i need to fill and list of documents to submit. just to let you know i am working as Contractor.

I just found the below :

1. PERSONAL DETAILS FORM (VAF4A DECEMBER 2013)
2. APPENDIX 2 (VAF 4A DECEMBER 2013)
Supporting documents:
1. Marriage Certificate
2. Photos
3. Main Applicant's Income Proof(I am earning more than £18,600 per year); from what date to what date i will have to show as proof. 1. Personal Bank Statement & Payslips,Dividend Letters, Accountant Letter. 2. Business Bank Statements.
4. English Language Proof.
5. Living Address in UK.

Should we also need to provide any Maintenance funds for last 3 months or so?

Please advise if i need to submit any other documents?

3. If you are self employed, you need to show 12 months bank statements and SA302, comp accounts etc. The most recent bank statement cannot be older than 28 days on the date of application.

No.

Also bear in mind that for self-employment, the qualifying income will be after allowable business expenses have been deducted. i.e the nett amount on which HMRC calculate tax due.

Yes, it is £600 surcharge for a spouse visa.

Yes. You only need to show more if you have non British children applying at the same time as your spouse.

as i mentioned in earlier, i am taking salary and dividends from my limited company, do i come under Self employed or Salaried?

I believe you are still classified under self employed for the purpose of the application - this was how I applied in December 2015 and they didn't seem to have any issue with it.

1. VAF4A was updated in March 2016, but I believe this is completed as an online application.

2. Appendix 2 -https://www.gov.uk/government/uploads/s ... endix2.pdf seems to be the most recent version.

Just a note from looking at your list of documents - you need to supply your CT600 ie.Your ltd company tax return - as well as evidence it has been filed with HMRC.

There are also a few other documents connected to your company which you need to provide which haven't been listed in your post (such as unaudited accounts).

Do I need to fill 1 each for my spouse and kid?

Or filling 1 form for spouse (selecting the first checkbox) is enough?

The below confuses me whether to fill one for my kid as well.

As the child of a parent who is applying for entry clearance as a partner or the child who is applying to join their parent who is already in the UK and has been granted limited leave as partner granted under the Immigration Rules in force on 09 July 2012.

I would suggest a bit more evidence of your relationship, flight tickets from visits, phone call records, skype/whatsapp etc history to show how you keep in touch while you are apart.

Does the rental agreement detail the size of the house (so that it wouldn't be overcrowded) and that your wife has permission to live there?

You also have to include evidence that you have paid the IHS charge.

Not sure you need the sponsorship undertaking document, I think it is for adult dependents (like parents/siblings) but I will check.

I can't advise about the employment info/English requirement as I am not familiar with them .
