spouse visa for my wife

Post by alisunny » Fri Aug 05, 2016 5:44 am

Hello dear

I'm British Citizen i got married in Pakistan last year,
I was apply spouse visa for my wife nearly about 2 month ago.
the application take 3 month.
We still waiting for outcome of application but I'm just wondering my wife was pregnant we have baby now he just bone week ago.

What we need to do for him shall we wait until the outcome of application or shall we apply emergency travel document.

Or we have to apply visa for him?

Looking forward to hearing from you

Child is British by descent. You have two options :

1. Apply for British passport directly. Can take a while from abroad.

2. Apply for Pakistani passport and CoE or RoA.

Emergency travel document is not possible if a person has never held a British passport.

CoE - Certificate of Entitlement
RoA - Right of Abode

You can start the process now, it is separate to your wife's application.

Hello Dear
i received decision refusal of my application. but i dont really understand that refusal i write you words by words why caseworker refusal us,

THE DECISION
EC-.P1.1(c) Section S-EC Suitability - Entry Clearance Requirements.
ECOs Reason for refusal.
. Requirements met

EC-p1.1- Section E_ECP; Eligibility for entry clearance as a partner.
Relationship Requirements
ECO Reasons for refusal
Requirements met.
Financial Requirements.
ECO Reasons for Refusal.

you state that you are exempt from meeting the income threshold because you sponsor receives Disability Living Allowance DLA and ESA. Appendix FM-SE states that you are required to provide the following as evidence of this.

(a) Official documentation from the DWP or Veterans agency confirming the current entitlement and the amount currently received.

(b) At least one personal bank statement in the 12-month period prior to the date of application showing payment of the amount of the benefit or allowance to which the person is currently entitled into their account.

you have not provided this evidence with your application. there is no DWP letter confirming your sponsor ESA entitlement or bank statement showing payment of either benefit or allowance. i therefore refuse your application under paragraph EC-P. 1.1 (d) of Appendix FM of the immigration Rules. E-ECP. 3.1

English Language Requirement.
ECO Reason for Refusals
Requirement met.

Had you sent them proof of the DLA and a bank statement confirming you receive it? If not, there are no real grounds for appeal and you would be better off re-applying, but adding the proof they required.

Just re-apply! You didn't send the info they required the first time around so it is not the UKVI's error here... It will be much faster to get a favourable result.

See also COE-RoA and associated links.

British citizens/people with the right of abode do not require TB tests, as they aren't subject to the Immigration rules. Application should be made in the same country as where child is at.
