Applying ILR for my kid to be born in China

Hi All,

Below is the situation, could anyone help on this?

Me and my wife have both got ILR through Tier 1 General (my Tier 1 General and my wife as dependant). A baby is expected later this year and we are going back to China to give birth. Then we will bring her back to the UK.

The problem is how do we apply IRL for her in China?

I visited the government website, the indication is not very clear there.

If the child is born in the UK, the child will be automatically British and can apply for a British Passport directly. Just a thought.


You apply for a child settlement visa - £1,195 plus the £600 immigration health surcharge. Child should be granted ILE (indefinite leave to enter) but sometimes this is not the case.

Thanks again. Had a look at the website you provided. There are a few things looking confusing, would you mind clarifying for me?
1. Form VAF4A. If I "Apply Online", is the form needed to be filled? Is the form only for applicants from North Korea (which is not my case) or for everyone.
2. It is a child applying to leave with parents case, so I guess no financial requirements need to be met, but I may need to meet "Adequate Maintenance". However there is no indication for how much the adequate maintenance should be. Do you have any idea on this?

Hello CR001, regarding the health surcharge, I did the calcualtion in gov.uk website, it says “0 pounds, exempt based on being under 16 and applying under visa Route: Settlement - Child or dependant of settled”.

The situation is me and my wife are both settled, the baby is applying to join us and is definitely under 16. I am a bit confused, do not know whether I need to pay 600 pounds or I do not need to pay anything at all.

Any idea? thanks.

Hi, did you get through the application process. How much surchage you paid and what is the adequate maintenance requirement. Did you fill Appendix1 or 3
