Tier2 dependent ILR eligibility

Hi, I came to uk on jun 2011 on tier2 ict VISA later i changed to tier 2 general visa in september 2013,then i extended my visa in this month, i will be eligible for ILR on september 2018, my wife came to uk on dependent visa by 2011 october then she was continued until 2015 september in uk ,then she went to india due to maternity ,now she is applying her visa from india.. after she comes uk we have 2 more years to apply ILR..my question is whether she can apply ILR along with me? or she need to spend 5 more years to get ILR

Has her visa expired? If yes, when did it expire?

No, she won't qualify for ILR with you a she is applying now for a new entry clearance which resets her clock to zero. Pity she didn't extend her visa before she left if it was possible or return before her visa expired.

She will need 5 years residence for ILR.

Thanks CR001,

Her visa not expired yet.visa validity is there until 30 Sep 2016.

we are going to apply my kid visa in india, at that time we are assuming to apply visa to my wife also.

now we will change plan.

i have two queries..

1. my wife can travel UK with in September 1st week with very short validity?

2. can i apply my KID dependent Visa even though my Wife having short validity?

Your wife can travel as long as her visa is valid, so yes she is fine to travel.
2. can i apply my KID dependent Visa even though my Wife having short validity?
Child's visa will likely be issued in line with yours. A letter explaining that your wife will apply for extension once she returns to the UK should be ok. I am not sure how a visa application for wife from abroad will affect her eligibility for ILR, suggest wait for FrontierMole or moonlight55 as they might know.

Any visa application made overseas is an entry clearance.

Extensions can only be applied for within the UK.
