You can't 'swap' spouse visas. As soon as your marriage is no longer subsisting (you separate or divorce) your current visa will be void. If you divorce and you then re-marry, you will have to apply for a new spouse visa from outside of the UK meeting all the conditions, including your new wife as your sponsor having a minimum annual income of £18,600. You aren't permitted to apply from within the UK.Anubis27 wrote:I came to UK from Egypt on a spousal visa. It has been very difficult and My UK wife has met someone else and would like to move on and I have also so. We have been together in the UK three years. I have built a successful business but if we divorce now I am two years short of my five years indefinite leave. If I remarry which from a personal point I would like to do but how does this affect my right to remain in the UK. Will it mean I can only apply for indefinite for ten years? How easy is it to swap spousal visa? I am successful in my own right, I have no need for financial support but if my new partner was a sponsor she doesn't qualify on the financial requirement. Yet my business is turning over £70k plus a year. Any suggestions or help on possible solutions greatly appreciated.
