Dependent of a British citizen

Post by ASHLYRAJAN » Thu Aug 11, 2016 11:37 am

Hello,
I have a question. I came to UK on May 2014 after getting married.
From May 2014 to September 2014, I stayed in UK as Tier 1 dependent.(On Oct 2014, my husband got ILR- he been in the UK for many years)
From October 2014, I been staying in a visa that says "Spouse of ILR(Spouse/ Leave to remain)" and this will expire in April 2017(next year).
Early this year (March 2016), my husband got British passport.
So when I am applying for visa extension next year, which visa type should I apply for?
I know there is a application form for "spouse of British citizens" , but my question is if I change my visa type to another type upon my next visa extension, will I have to wait another 5 more years to apply for ILR? Or shall I use "FLR for visa extension next year till I complete 5 years and then I can apply for ILR?
Is there anything like " we need to stay in the same visa type consistently to apply for ILR?
Please advise
R

You don't change your visa type. You extend your current visa on FLR(M) which is 'spouse of BC or person settled'. What you have an what a spouse of BC gets is the same visa.
