ILR for Tier2 dependent

Post by neurocyber » Thu Aug 11, 2016 12:50 pm

Hello all,

I have Tier-2 visa valid till 30 Jan 2020 and my wife also has visa till same date. Hopefully, i will complete 5 year residency requirement for ILR within the validity of my visa but my wife joined me into the U.K. 3 months later then me (June,2015) therefore I am a bit confused about her eligibility. She visits her parents quite often.... (30 - 40 days holidays/year in total). Which means it will become 200 plus days out of U.K. when her visa will expire in Jan, 2020.
She might be short of 3 months of 5 year residency requirement when her visa will expire. Would she need an extension for Tier2 dependent visa? When she can apply for ILR ? How holidays effect the residency period?
Suggestions are welcome please. Many thanks in advance.

She will need an extension to cover the shortfall. She can only apply for ILR within 28 days of reaching 5 years residence.

Absences should not be a problem. The 180 days per year limit is ONLY applicable to the main Tier 2 G visa holder.
