Tax credits not granted yet as TA partner has no NI number

Hi I'm writing today to get a little advice.

My partner and I came here to give birth to our son. I am British and my partner is non-european.
Long story short, she has temporary admission till 1st march 2016 with no recourse to public funds.

I've applied for tax credits about a month ago and after calls to see what's going on, the claim had been passed to complicated claim team and later it had been put on hold due to the request of additional info.

So they've asked for my partners national insurance number which she doesn't have and as far as I'm aware isn't entitled to one as she isn't permitted to work.
They also requested her passport but that is with the home office.

What can we do to be able to get these tax credits. There must be a way.

When did you arrive in the UK?

How long were you away from the UK before returning?

Are you working?

When was child born?

What visa did she enter the UK with?

Why is her passport with HO?

We arrived at the beginning on April and had the baby in may. It had been longer than three months before I applied. I work.

Basically I am eligible it's just my partners situation with not having these things.

She didn't enter with a visa. Basically we were coming over for the 6 months but were refused and temporary admission was given. She is subject to immigration control till we find out what to do about staying. They took her passport and haven't given it back.

In addition to CR001's questions, how did you pay the medical fees for the birth of the baby and any pre-natal/ante-natal care as your partner has no free access to NHS treatment?

Be aware that as your partner is subject to Immigration control the second adult element of WTC will generally not be awarded.

Thanks for the link. So according to the post we are eligible to receive tax credits. But the question now is how to make them aware of the entitlement.
