Spousal Visa Refused (Help Please)

Hi All,

I would like to thank everyone in advance for providing feedback!

I was denied the renewal of my Spousal Visa due to not supplying the correct specified evidence of earnings for the last 6mths.

We provided 3mths worth of payslips and group certificates covering the 12mths prior to that. We also provided 6mths worth of bank statements (stamped by the bank) and letters from both our employers. We both earn well over the threshold of 18,600GBP per annum.

I feel that they rejected our application because we didn't provided the payslips instead and instead provided group certificates.

My question is should we:
A) re-apply
B) write to them for a reconsideration
c) Appeal through the tribunal under Section 82

We can get the payslips however we presumed that the group certificates would suffice.

What are group certificates?
Excuse my bluntness but you knew exactly what to submit and should have done so. As you have the information requested you can appeal but I don't know how long that process takes so submitting a fresh application may be quicker.

You are right, we should have complied correctly.
It was a timing issue getting the payslips reprinted.
I really just need to get it sorted asap so that I can keep working.
If we were to appeal, does anyone know which process to follow? reconsideration or tribunal?

Group certificate = payment summary for the previous tax year received from your employer.

You mean a P60?

HO want to see PAYSLIPS and bank statements, each for 6 months (or 12 months if two jobs). The guidance is very clear.

There's no point in appealing if the decision has been correct due to lack of the required documentation.
(Casa, not CR001)

Reapplying will be much quicker. Appeals are take many months, sometimes up to a year now.

If you don't appeal, your wife will lose her rights to work under Section 3C, unless you do a premium service appointment the day after her time limit for appealing , and make sure you get it right this time .

I've booked in for a premium service however the Home Office still has my passport. Do you know if they hold onto it or send it back?
I spoke to customer service and they said they keep it, I spoke to an advisor and they said they send it back?
