ILR eligibility after different types of visas

Post by findsmitaatnet » Mon Aug 15, 2016 2:39 pm

Hi,

I came to the UK on Tier 2 ICT in Jan 2013. My husband came to the UK on Tier 2 General in April 2013. I switched my visa to Tier-2 General Dependent in Sep 2013. My husband will be eligible for ILR in April 2018. Will I be eligible for ILR application as well in April 2018 as I will have already completed 5 years in the UK (including Tier-2 ICT and General dependent visas)? Please note that we have been living together from April 2013 (since my husband came to the UK).

Thanks in advance.

Smita

No, you cannot combine your Tier 2 ICT with Tier 2 dep visas to make up the 5 years residence for ILR. Tier 2 ICT does not lead to ILR anyway.

You need 5 years on Tier 2 G dependent so will qualify for ILR in September 2018, within 28 days of reaching 5 years.

Thanks for your prompt reply. My tier 2 general dependent visa runs out in April 2018,so what are my options?

Thanks,

You will have to apply for an extension of your current visa once your partner gets ILR.

Thanks again Char. Will I be able to extend my Tier-2 General dependent VISA after my partner gets his ILR? Can you please send me the gov.uk link with the details?

Yes you can, as long as your partner gets ILR based on Tier 2 General and NOT based on 10 years long residence.

See Dependents of ILR economic 5 year route (clikc) and scroll down to the Tier 2 dependent bit and you will see links to the immigration rules.
