Visa extension for Tier 2 dependent of an ILR holder

Post by virtual123 » Mon Aug 15, 2016 7:02 pm

Hi all,

I have an ILR now and was on a Tier 2 (General) visa before that.
My Wife entered UK as a Tier 2 Dependent and her visa expires on 17 Dec 2016.

By the time her visa expires, she would be in the UK as a Tier 2 Dependent for only 3 years and hence is not yet eligible to apply for an ILR.

Can I apply an extension application for her as a Tier 2 dependent for another 2 years based on her earlier visa even though I have an ILR now?
My worry is if I change the visa type now then her 5 year clock for her to be eligible for an ILR will be reset.
Could you advise ways to extend her dependant visa with out losing the 3 years she already spent here to be counted towards an ILR?

Many Thanks and I appreciate your guidance and responses.

Yes, she can continue to extend her PBS Dependent visa but only if you applied for ILR based on 5 years residence Tier 2 G. See link below.

Yes I did apply my ILR as I was living and working in the UK on Tier 2 (General) visa for 5 years.

Thanks for your response CR001. Its a sigh of relief !
