Dear all
I am in a bit of a situation and wondered if someone can help. I am a british citizen (5yr route). My wife delivered in india and has since been out there as we wait for the overseas passport for my son.
My wife's spouse visa expires in September and it looks like the overseas passport application will not be completed in time for her to be here to extend it. (Spouse visa cannot be extended from abroad?)
We are preparing for the worst case scenario and it would mean that my wife will have to come here for a couple of days, get the visa extended and go back to India while my parents take care of my son.
Has anyone been in such a situation? Any ideas how we can resolve the situation in a better way?
For the spouse visa extension, I plan to supply:
1. Signed application with two photographs of her and one of mine
2. My wife's and my bank statement.
3. Council tax (me and my wife's name).
4. My payslips for the last 6 months.
5. Photocopy of the marriage certificate (original is with the passport office for son's application)
6. Wife's masters degree from India with transcripts.(English requirement)
7. Photocopy of my British passport pages showing my India trip to visit my wife.
8. Family photographs and Whatsapp chat history
9. Tenancy agreement (in my name only).
10. Letter from my company stating years at work and salary.
Am I missing something? Thanks again for looking.

Assuming she will apply at premium centre for in person appointment/decision, she will still wait a couple of weeks for her BRP card.
1. Signed application with two photographs of her and one of mine
2. My wife's and my bank statement. 6 months worth. Whose salary are you relying on? Do you meet the £22,400pa requirement? Her bank statements can be used for cohabitation proof.
3. Council tax (me and my wife's name). You need documents proving cohabitation for the last 2 years from 6 different source in joint name or more sources if in single names.
4. My payslips for the last 6 months. Must be latest, most recent one not older than 28 days. Your bank statements if relying on your income.
5. Photocopy of the marriage certificate (original is with the passport office for son's application) HO will expect to see the original cert. HO might expect to see the birth cert of the child.
6. Wife's masters degree from India with transcripts.(English requirement) She needs the ELA from NARIC if using an overseas degree. Transcripts are no longer sufficient.
7. Photocopy of my British passport pages showing my India trip to visit my wife. Assuming you are attending PSC appointment with her, take original passport.
8. Family photographs and Whatsapp chat history Photos are not necessary. HO wants to see proof of subsisting marriage and communication evidence for the time that she has been away.
9. Tenancy agreement (in my name only). Fine, see my answer at #3 above.
10. Letter from my company stating years at work and salary. Plus your contract
She will also have to pay the £500 immigration health surcharge before she can apply in addition to the visa fee of £1,311 if applying in person.

Is it possible for me to apply a week before her visa expiry and send her back before the visa expires? i can then travel with the BRP to get her back.

It will be my salary. I do meet the criteria. I plan to use her bank statement for the cohabition proof.

Wow! So I can add- My DVLA, Wife's provisional license, Her NHS letter, Gas bill in my name, My NHS card

I will try getting true copies of original from India. Could include the letter from passport office requesting for these documents.

This was accepted when we applied for her visa in Oct 2013. Could you tell me the procedure to apply for this letter?

My contract is quite outdated. Been with the company for over 6yrs now. Will include latest P60

Doesn't matter if contract is outdated. That together with a recent employer letter summarising your terms of employment etc will suffice.
3. What else do you have addressed jointly or individually?
6. The rules regarding foreign degrees changed in April this year. See
NARIC for Immigration (click). If she doesn't do NARIC, she will have to do the A1 English Test from one of the HO approved test providers.

I dont have a lot more than stated. CAn you suggest more documents I could include? Cant think of any

Thanks for the info. I will sort out the NARIC letter. Is there a way I can check the Master's degree from INdia will be approved by NARIC before I apply?

Hi Cr001,
After your advice and going through the example mentioned in the form, I have dug around to find documents I could submit. NOTE that this is only for Cohabitation requirement. Please could you have a look.
The requirement is to have 6 joint addressed docs or 2 for each in case docs are individually addressed. It also says it has to be a minimum of 3 sources.
Joint Addressed:
1. Council tax: 3 years
2. Electoral registration confirmation: Though this is not mentioned under example of documents, the local council is a govt body(?)
This one I am not sure about: Antenatal record showing my wife's name and address along with my name and date of birth. (will this be considered a jointly addressed?)
If the two mentioned above are OK, I will need to submit 4 documents for each of us:
Wife:
1. Bank Statement and a letter x2 (one from 2014, another from 2016)
2. NHS prescription and an appointment letter (2014 and 2015)
3. DVLA Provisional Licence
Me:
1. Gas Bills (x2) latest and the oldest
2. TV licence (2 for the past 2years)
3. Tenancy agreement (latest)
4. DVLA licence
your help is greatly appreciated. Thanks again

Any correspondence which includes the date, name or names & address will be accepted.
You can only submit a FLR(M) application from within the UK.
(Casa, not CR001)

Thanks for the response. Sorry to be a pain, but I am rewriting the exact list that I intend to apply with. The requirement of the documents needing to be spread across the period worries me as I am not sure how much is enough.
Cohabition documents
Joint name:
(1) Council Tax: 2014, 2015, 2016
(2) Electoral list confirmation: Jan 2016
(3) Transcrpits of Whatsapp chat to show contact during the days she has been in India (about 11 months)
(4) photocopy of pages on my passport showing my trips to india to see her
Docs in Wife's name: (lack of 2016 docs as she has not been in the country for the year. No bank statements were sent due to lack of transactions. I think I can request a new one should the below isnt sufficient):
(1) NHS prescription slip: Nov 2014
(2) NHS appointment letter: June 2015
(3) Bank statement: May 2014; Bank account summary: Mar 2016
(4) DVLA Provisional Licence
