Hi there all ive messaged on here before with a few different kinds of questions but all related to one thing.
My partner and i are now thinking of going back to his country to get married so if anyone can give us information on this it would help with our decisions, He is algerian, and i am fine with going back to algeria to get married but i dont want to live there and nor does he, however i do know there is conditions of having salary of £18500pa or savings, but i dont know how long it would take for me to bring him back home, or do i have to stay with him for a certain length of time?? Our life here is difficult at the moment as i have 2 grown up sons who still need me at the moment and my mother, i also have my own business which means i cant take too much time off work. Again any info is helpful.

There is no requirement for you to stay in his country but for a spouse visa application you will need to submit evidence of subsisting marriage if away from each other for a long period. You need £18,600pa and as you have your own business, it will depend on how you pay yourself.

What do you mean show evidence of subsisting marriage? and how long doe the application take for example how long would it take for him to return home to me in the uk? and what do you mean how i pay myself, what way should i pay myself for the application to be successful? thanks for quick reply x

Subsisting marriage = communication evidence, visits etc.

A spouse can take a few months.

If you work for yourself, are you on the payroll as PAYE or do you take dividends? Is it a imited company or a sole trader etc? How you do "salary" will depend on what and for ow long the evidence of income has to be.

Ok thank you well that sort of evidence wouldnt be a problem. I am a sole trader and take drawings on a monthly basis. And when you say months do you mean more than a year or 3-6 months?

Probably 3-6 months.

Bear in mind that when qualifying with self-employed earnings to meet the £18,600 p.a., it's the nett amount after allowable business expenses have been deducted. In other words, the amount on which HMRC have calculated tax due.
