Switch from Tier 2 ICT Dependent to Tier 2 General

Post by alokns1 » Tue Sep 06, 2016 9:43 pm

Hi,
I am working on Tier 2 ICT long term visa in UK and my wife has a ICT dependent visa and is working for a separate company.
Her company is ok to sponsor her TIER 2 general visa however its not clear what is the minimum salary level in her case. She has been with the company for 1.5 years and looking to UK Gov website it appears salary needed is £20800.
Can someone help to confirm if this is correct as on some blogs we read that threshold has been changed to £35000.
Also if my wife joins a a different company, would the salary threshold change? As on some blogs its suggested that salary requirement is different for new entrant versus existing workers.

Please advise. Thanks

There is no salary threshold defined for dependents. They just need to be paid the minimum national wage as defined by the government (which I think is 6.70 per hr). Anything above is fine. The thresholds defined is only for the main applicant.

The 35K you mentioned is the minimum salary for people applying for ILR. This does not apply to you or your spouse.

Dependent wants to apply for tier 2 general.

Ah! My mistake. Thanks CR001 for catching this.

@alokns1: Correction - Yes, your spouse will be subject to a minimum salary which will be dependent on the SOC code & job role. You can refer the SOC list to find the minimum. Note that the minimum could be higher than 20,800 based on the role.

Just to add, her employer has to conduct RLMT to demonstrate that they could not find a suitable candidate frm UK/EU before then can hire her on Tier 2 General. Most likely, her application will be subject to scrutiny by UKVI since there could be an element of pre-selection since she is already working for the same company. Please do some reading on this forum, there are many cases where the visa application was rejected due to RLMT not being conducted properly.
