Evicted by court order

Post by smir » Mon Sep 05, 2016 3:19 pm

I have been evicted by court and told to pay landlord court cost,

Rent was always on time

Do I need to disclose this in the naturalisation form ?

As it was civil matter and I went to court for it

No does not need to be declared. If you don't pay your landlords court costs though, they can apply for a CCJ. Best to pay the costs before that.

3.4 Give details for each civil judgment or any civil penalty under the UK immigration acts, starting with the most recent one.

Form says this.

If I don't declare then will it be not that I hid something from or didn't gave them full information ?

As I did attended court to defend my eviction as my wife was pregnant at that time and I needed enough time to take her care

And only evicted the property when landlord applied for bailiff and bailiff came and evicted me few months a go

It is NOT a civil judgement and NOT a civil penalty!!!

What you have is simply an order for costs because you were evicted by court. YOU DO NOT HAVE TO MENTION IT!!!

A CCJ is a civil judgement, which you will likely get if you do not pay the court costs.

Thanks Brother

You are right

It's not CCJ or penalty

Court confirmed it to me

Sorry Sister

Got confused again

Was filling AN form and reading guide lines

You stated eviction is just court order and no need to disclose

But Guidelines of AN states that even court order that I need to be declared

Please guide again

Following is the reading from guidelines

3.3 – 3.4 You must give details of all civil judgments which have resulted in a court order being made against you as well as any civil penalties under the UK Immigration Acts. If you have been declared bankrupt at any time you should give details of the bankruptcy proceedings. (Your application is unlikely to succeed if you are an undischarged bankrupt).

Claiming Housing Benefits

Post by smir » Wed Mar 01, 2017 5:12 pm

CR001 wrote:Contact your local council housing benefit department. Don't think you would get very much. If your wife works, her income will also be taken into account to determine eligibility.

Use the benefit calculator in the link below to determine how much you might be entitled to.

You should be awarded single+child rate. Your wife is subject to immigration control.

CR001 if you can throw some light in my case

Husband and three kids all are British citizen

Wife visa was still pending but now judge allowed appeal.

Now I was made homeless so went to council, and council assisted me to reaccomodate and offered me flat and also advised me to claim HB as my salary was low otherwise I can't afford rent which I need to pay to council and so I claimed.

When they issued tenant agreement it was in me and wife name

I asked them that why you added my wife name ? They said don't worry your wife name is just in tenancy and we are not giving any HB in your wife name. But you are just claiming HB in your name and your wife is just part of family.

Now I am not council tenant, council put me in Temp accommodation in privately rented property for which I pay rent to council and council pay rent to private landlord.

Now is this wrong ? Or it will affect me ? Clearly at time of homeless application i mentioned clearly that she is my wife.

My homeless application was decided on my ILR card, children birth certificates and wife's copy of passport (Pakistan) and at that time she didn't even has any visa.

Guide me please

This is normal to have both adults on the tenancy agreement. Stop worrying.

Now I am British citizen, with three kids all British

My wife has been issued visa through appeal, 10 year partner route with no recourse to public funds (30 months visa)

Now checking the benefit letter it states :

Following information we used to calculate your HB

Wife income (n/a) = £0

Couple with person between 18 and pension = 114.85

Young person under 11 * 3 = 200.70

Now there is no mention of name of my wife as all I claim in my name

Do you think there will be problem for my wife extension in future ? What should I ? Is this wrong ? I didn't hide anything from council as I gVe them all docs needed

Please guide
