Impact of Child Benefit on Future Applications

Post by harshitguptaiitr » Sun Sep 18, 2016 3:49 pm

Please can you advise on the following case of a family:
  • Mar-2010: Tier 2 ICT Migrant Visa granted
Apr-2010: Arrived in UK and started employment
    Feb-2014: Got Married
Mar-2014: Spouse came to UK as Tier 2 Dependent
2015: Unfortunately, due to strong compelling personal reasons, did not apply for ILR
Oct-2015: Spouse went to home country during pregnancy
Mar-2016: Child born to the couple outside the UK.
Apr-2016: Child and mother comes back to the UK (Child spent less than 2 months in home country and mother spent 178 days) as a Tier 2 ICT Dependent with Visa validity Dec-2018
Sep-2016: Friend granted Indefinite Leave to Remain in the UK.
Mother is a house-wife (i.e. not earning money in the UK).

Family has following plans:
  • Father will apply for British Citizenship in late 2017.
Mother and child will apply for ILR in mid 2019.
Child will apply for British Citizenship in mid 2020.
Father has annual income (before tax) greater than 50,000 GBP.

Father wants to claim Child Benefit (20.70 per week). He is aware that a tax needs to be paid on this benefit.

Please can you share your thoughts if claiming Child Benefit under name of father will affect any future UK Visa application of the family?

As I already stated in your other thread, the father with ILR can claim child benefit and will NOT have an effect on future dependent applications.

Thanks.

The Child Benefit Form is stating: Please send a copy of your Home Office documents to us with this claim.

Will this be my new Biometric Resident Permit (original and photocopy) ?

The letter from Home Office that I received on day of my PSC application did not explicitly state that ILR has been granted. All it said was that my passport is being returned today and that my BRP will come in post.

Thanks for your help.
