ICT Tier 2 Long Term to Tier 2 General dependent

Post by mmani » Thu Oct 06, 2016 5:51 pm

Hi,
I'm in the UK on Tier 2 ICT Long Term visa which expires on 10 Sep 2018. My husband is on Tier 2 General visa and his sponsor company is currently processing 3 years extension of his visa, which he should receive in a few weeks time. Due to maternity policy in my company, I've been asked to return to my home country by mid-January 2017 at which time my sponsor will terminate the CoS.
1. I'm assuming this means my visa will automatically expire when the CoS ends?
2. Can I go back to home country (India) and then apply from there as Tier 2 general dependent or does cooling off period apply to me?
3. If cooling off period applies then, can I switch to my husband's visa as Tier 2 General dependent from within UK before I leave in mid-January? If so, how soon should I start the process as he has not received his visa still.
4. If I can get the visa in-country before I leave, can I leave in mid-Jan as planned and stay outside country for longer than 6 months (8 months) before I return or will it affect my entry?

Thanks

1. Not necessarily. Once your sponsor informs HO that they have withdrawn their sponsorship, HO takes a while to send you a curtailment letter.

2. You can apply for a Tier 2 Dependent visa WITHIN the UK, there is not need to leave and do it. No, cooling off not applicable if you are applying as a dependent.

3. See #2 above.

4. You can leave once you receive your BRP card and yes, you can stay out for your maternity. Make sure you maintain records of visits/contact with your partner.
