Tier 2 General Extension from Same employer

Hi All,

my current visa gonna end in Dec'2016 and i am planning to extend my VISA from same employer I am Currently with. My current VISA is switched from Student to Tier 2 and i am on £24k salary. Can you please clarify the below questions:

1. As i switched from Student to Tier 2, they is no RLMT when i got my first VISA, do the employer need to do RLMT now for extension (Referring to point from UKVI document "38.23 If you originally carried out a resident labour market test before you started sponsoring the migrant, you do not have to do another one")

2. When I can go for extension as my last date of current VISA is 28th Dec 2016?

3. Current SOC is 2139, What should be my salary now?

Hi,
i applied in end of april tier 2 visa extension with same employer but i am still waiting for decision. i mean time i have received 2 letters.they keep saying in process.
is anyone know what should i do now?

Thanks for the replay 'iworker'.

I read some where that tier 2 applicant should be on 36K to get eligibility for ILR.

1. Is that I can raise my salary to 35K now or I go for 30K for now?
2. If I go for 30K now, when is the right time to raise my salary for 36K?
3. My ILR due date is in Dec/2018, what is the basic requirement for ILR and for how many months before my ILR application it should start?

1. No RLMT is required, However, your employer need to assign a new Unrestricted CoS for your extension. You need to find out if your company has one for you. if not, they need to request ASAP.

2. You can apply for your extension anytime but I'd say the earlier the better. You don't have as much time as you think especially if you intend to go for standard application.

3. You will be treated as an experienced worker so you salary should be £29,900. Your current salary is £5,900 short.

I am sure you have figured it out now that you don't really have much time and that you need to act quickly.

I wish you all the best of luck and favour as you negotiate for a new salary and apply for your extension.

Your main goal now is to earn experienced worker's salary for your SOC (£29,900) so you can extend your visa. Once you have extended your visa, then you have two years to work towards earning the minimum 35K required for your ILR.
At the moment, your tier 2 visa extension is more important than ILR becuase you need the extension to qualify for ILR.

Just a quick question. In terms of the new salary does the company have to start paying before applying for the extension visa? Or they start paying from the start day on the cos?
