Dependants who havent completed 5years for ILR

Post by wizardanil » Tue Oct 18, 2016 2:36 pm

This is regarding an application for myself (ILR) and two dependants(wife and 1 year old son) who haven’t completed 5 years stay.
My wife has completed two years as tier 2 dependent and son would have completed 1 year by the time of the tier 2 dependent visa expiry.
Should the dependants extend the visa as PBS dependants or apply under FLR(M)? Would my son be able to apply for ILR as the same time as mine(using SET(F) form )or should he apply along with the mother as PBS dependents or FLR(M) .

Can you please advise the appropriate route by which the dependent application should be made.

Any assistance would be highly appreciated.

How did you obtain ILR? Through the 5 year or long residence route?
(Casa, not CR001)

Thanks for the response.
I will be eligible for ILR by 11.04.2017 and will my wife and son visa expire at the same time. I would have completed 5 year stay in UK by then. The visa type is tier 2.
My son was born in india

They can continue to extend their current visas until they meet the requirements for ILR. They must apply before their visas expires.

Guys,

so i understand that both of the dependants should apply for a tier 2 extension if i am not wrong isn't it? If that is the case how long will the new visa be for once granted?
