Tier 2 (general) visa: job terminated, what are my options?

Post by mosal » Fri Oct 21, 2016 10:06 pm

Dear friends

I am currently working in London under Tier 2 General visa. My employer is terminating my contract by the end date of my visa (15 December 2016) just because they're not willing to give me a payrise to meet the minimum salary required t renew my visa.

I am actively looking for another job to try apply for a new visa before my current visa expires on 15 December 2016. I understand that I can still apply within the 28 day grace period if I find a job within the next two months or so.

But my questions is: If I am aiming to seek indefinite leave to remain and considering that I spent 2 out of the 5 years, is it true that if I can't find a job and if I leave the UK on a valid visa (i.e. before 15 December 2016) and come back on another valid Tier 2 visa within 6 months, the it like I haven't left and I need another 3 years to apply for ILR visa?

Can you please shed a light?

Thanks very much in advance

If you don't find another sponsor and leave the UK, you will be subject to the 12 month cooling off period before you can apply and come back. This will start a new 5 year qualifying period for ILR.

What you have 'heard' is not correct.

Thanks CR001, it'd be a shame if I can't find another job
