Tier 2 Sponsor Licence and Switching

Post by IS777 » Sun Oct 23, 2016 9:58 pm

Dear Experts,
. I recently complete PhD (Finance) and now on Tier 4 (Post Doctoral Extension Scheme) and searching for a career opportunity but no luck so far and only have 7 months left.
. I also have retail business (Shoe Shop & Menswear), which I bought from previous owner on 15 years long lease, lease in on my name but I changed the company director from myself to someone else in early 2015. I don't know, how far I was right in starting this business while on Tier 4 visa for my PhD and whether the lease on my name or changing the company director have any effect?
. Now is there any possibility of using this same company to get a tier 2 sponsor licence and then hire me as Finance/Admin manager? I do understand in my current situation, employer doesn't need to meet RLMT and the job also doesn't need to be on shortage occupation list.
. Just in case if there is possibility, then if the company can hire me now (as I am allowed to work full time) and mention in the sponsor licence application that the main reason for the licence is this worker, we already hire him because of such and such reasons and we wish him to continue ... Therefore, we need this licence?

Please assist if anybody understand the situation, I am trying to explain and advise further course of action. Thank You.

Your own business cannot sponsor you.
"Engaging in Business Activity
A Tier 4 visa does not allow you to engage in business activity. The Home Office defines this as working
for a business in a capacity other than an employee in which you have a financial or other significant
beneficial interest. You would not be permitted, for example, to set up a business that is trading or has a
trading presence, be employed by a company in which you hold shares of 10% or more or work for a
company where you hold a statutory role, such as a director
. This is not an exhaustive list but provides
examples of the types of circumstance in which you would be considered to be engaged in business
activity."
