Submit a T2 dependant extension visa application 9 month bef

I was on T2 general visa until 11.08.2016 when I switched to ILR on the 5 years’ road.

My wife and my 3 children are still having T2 dependant visas expire on 14.12.2017.

They will need to extend their T2 dependant visas at least to 07.10.2018 to complete their 5 years on the T2 dependant visa and be eligible for ILR.

However, they only need to extend their visas for 10 months, the home office regulation will force them to extend their visas for 3 years. Therefore, my wife will pay extra £600 for the ‘immigration health surcharge’ or IHS.

I want to submit T2 dependant applications for my wife and children around March 2017. This will be around 9 months before the expiry date of their visas.

My questions:

Is there any problem to submit a T2 dependant extension visa application 9 month before the expiry date of T2 dependant visa? (main applicant on ILR 5 years’ road)

Will it be possible to claim some of the immigration health surcharge or HIS’ money as they need to 00 years only to be qualified for ILR but forced to get 3 years’ visa?

They can apply any time before the visas expire.

As you have ILR, they will get a standard 3 year extension as you have stated.

As CR001 said, they can apply anytime for extension.

Regarding IHS, you will have to pay for your wife and children at the time of extension as it is mandatory to be paid but you may get a refund once they successfully get their ILR.

If you search the forum, some members have successfully reclaimed the IHS by contacting UKVI for the overlapping period once they have ILR. There is no guarantee that you will get a refund but its worth trying.

In page 10, you will find this question answered as Yes:

Is knowledge of language and life required? Yes

Am I looking at the wrong place?
