Financial Requirement for SET (M)

Post by Cudda » Thu Oct 27, 2016 9:07 am

Hi Everyone,

This is my first post on this forum, I have read many peoples story hear and believe me I feel for everyone. My wife’s FLR (M) extension is due to expire in September 2017 and I would like to get much information as possible before we apply for the ILR SET (M).

1) My question is since my wife came via the 5 year route do we have to meet the £18,600 financial requirement if so would my wife’s £21,000 per year salary be enough to meet the threshold or do I have to also provide evidence of my income as well in the application form?

On section 8 it states “You must provide evidence that your partner is able to adequately maintain you and any dependants in the United Kingdom without recourse to public fund”

As you can see above it states that evidence from the partner is required hence my confusion.

2) Also if we have children and apply for Child Tax credit ( if we are entitled any) would this in undermine my wife’s application? Child Tax Credit is listed under public funds on section 8.

Any information from the members would be greatly appreciated.

Your wife's salary alone will qualify.

On section 8 it states “You must provide evidence that your partner is able to adequately maintain you and any dependants in the United Kingdom without recourse to public fund” This was for entry only. Joint income (or from either sponsor or spouse) will qualify

As you can see above it states that evidence from the partner is required hence my confusion.

Welcome to the forum.

2) Also if we have children and apply for Child Tax credit ( if we are entitled any) would this in undermine my wife’s application? Child Tax Credit is listed under public funds on section 8. Child Tax Credit must be claimed in JOINT names. Child Benefit in your name only. Claiming in this way won't adversely affect your wife's ILR application.

Any information from the members would be greatly appreciated.

Thanks for the info so only I only need to Provide the Mrs Salary (Would 6 months worth of bank statements and payslips in sync be enough?

We haven’t had any children and we have never claimed any public funds so really am worried if we have baby before ILR and we claim Child Tax credit and Child benefit (thought the Nasty Tories scrapped that) it wont effect her application.

My sister has a child and gets about £20 per month in child tax credit as a working mum and tells me if you and your partner earn less than £45,000 you are entitled some Child Tax credit although its not much but I really don’t want to claim anything if it will jeopardise my wife’s application.

Why do you think child benefit has been scrapped? It has not. Child benefit in YOUR name only and tax credits in JOINT names with spouse. If claimed correctly like this, no effect on ILR application.
