FLR -dates to apply for renewal

Post by sherb » Tue Nov 01, 2016 5:55 pm

Hi,
I got my entry clearance on 21-04-2015 valid to 21-01-2018, I entered the country on 15-05-2015,I know i have to apply for FLR,is this done 28 days before the expiry of the visa or 3 months before the expiry,
i read here in the forum ,its 30 month residence mark from date of entry. Please can anyone clarify this for me.

My daughter, aged 14, has the entry clearance valid 22-07-2015 to 21-08-2015, entered country on 22-07-2015, her residence permit is valid until 21-01-2018, same as mine.
Do I renew her visa with mine or should i do it at a later date?

regards
Sherb

She should apply for her extension shortly before the 30 month residence mark, calculated from date of entry to the UK on spouse visa.

My advice is correct and won't change.

Apply once resident for 2.5 years. Apply for daughter as dependent on your FLR(M) form.

Thank you CR001 for the quick reply...... if I add my daughter as my dependent on FLR form when I renew my visa, she would not have completed 2.5 years, is that ok ?

It is fine. Daughter must apply with the other parent on FLR(M).

Hi
Regarding the renewal dates I understand it is

Date of entry + 30 months - 28 days

Is there any problem if I do it after the 28 days ? That is after the 28 days to the date of visa expiry ?

Regards
Sherb

You MUST apply for a visa extension BEFORE the current visa expires. You can apply for an extension WITHIN 28 days before visa expires, it does not have to be on exactly the 28th day.

Thank you for the quick response. I have spoken to a solicitor for my paperwork as there was some complication for the spouse visa renewal. He said it was ok to renew anytime before the expiry date on the visa and need not worry about the 30 month from date of entry. He said the later the better and 28 days time stamp is only for ILR.

My visa valid from 21-04-2015 to 21-01-2018
Date of entry - 15-05-2015
30 month - 15-11-2017.

Is 15-11-2017 the expiry of my visa or 21-01-2018 ?
I know it might be a lame question but I’m confused.

Regards
Sherb

The expiry date is 21 January 2018.

28 day concession applies to ALL visa/ILR applications. It is NOT only for ILR.

You should not apply too soon before she reaches 2.5 years residence. lf you apply too early, you could end up with a shortfall for ILR and then require a 3rd extension to cover a few months.

Remember that you have to pay the visa fee and immigration health surcharge and your spouse also now needs English A2 for her extension.

What complications?

Thank you for the information. Yeah I passed my English test on Saturday and have the provisional certificate.

Me and husband (British citizen) are both working , my annual income is 17500/-,
husband was earning 22000/- Plus private pension- 4500/- annually
My husband was off work as he had a Surgery and received only statuary sick pay for 3 months. he changed 2 job in the last 6 months as he could not go back to his old job. He has started a new job last week. So in the last 12 months he has been with 4 different employer.
I was not sure about combining the income. I know it has to be done under category B.
And the FLRm form was confusing so I spoke to a solicitor that the citizens advice referred.
