ILR application SET(O) for dependant only queries

Post by hktony » Tue Nov 01, 2016 8:54 pm

Hi everyone,

I am in the situation that I have to apply ILR for my wife this month via Tier 2 dependent visa route (2 years route)

I have searched all posts in the forum regarding the application of SET(O) - Tier 2 dependent when partner already got ILR, but none of them are in very details

Form: SET (O)
Section 1 (Applicant details) – My wife details
Section 2 (Dependants who are also applying) – should I fill in or leave it blank ?
Section 3 (Which category) – Tier2 dependant
Section 4 (Knowledge of language and life in the UK)- Fill in “you” instead of “your partner” ?
Section 5 (Your home and finances) – should I fill in my details or her, as my wife is not working?
Section 6 (Immigration history) – my or her immigration history ? as I know her days of absence in uk is not a criteria for her ILR application. However, I don’t think I would need to fill in this section as I already had ILR if immigration history is for me
Section 7 (Personal history) – my wife’s criminal history ?
Section 8 (Photographs) – my wife photographs
Section 9 (Tier 1 point scoring assessment) – leaving blank
Section 10 - Biometric residence permit – my wife’s BRP details
Section 11 - Passport, travel document or national identity card – my wife’s passport information

Supporting documents:
photographs
my 3 months payslips
my 3 months bank statements
Life in the UK test pass certificate
UK degree certificate
Passports and BRP
cohabitation proof for any 2 years

I hope anyone can help me in this situation, as I am really confused about the SET(O) application form when filling in for dependent only (wife)

Thank you so much

Tony

Your wife is the MAIN applicant, you complete the relevant sections with HER details, i.e LIUK, English, etc.

Thanks for answering me

So am I getting them all right now?

Section 1 (Applicant details) – My wife details
Section 2 (Dependants who are also applying) – leave it blank
Section 3 (Which category) – Tier2 dependant
Section 4 (Knowledge of language and life in the UK)- Fill in “you”
Section 5 (Your home and finances) – fill in her details, If my wife doesn't work, so I have to fill in 5.4(NO) and 5.6(income source from me) ?
Section 6 (Immigration history) – her immigration history, but how long I have to mention her absence in UK, 5 years?
Section 7 (Personal history) – my wife’s criminal history
Section 8 (Photographs) – my wife photographs
Section 9 (Tier 1 point scoring assessment) – leaving blank
Section 10 - Biometric residence permit – my wife’s BRP details
Section 11 - Passport, travel document or national identity card – my wife’s passport information

Supporting documents:

Tony

Regarding cohabitation documnet, I know the minimum requirement is 4 documents every year in joint names in 3 different sources.

My case is any 2 year letters after she has tier 2 dependant visa.

But it is impossible for me to get all letters in joint names/single name evenly spread over 2 years.

Is it possible to give letters in different name spreading across different months
e.g. Me: Jan, April, Jun, Aug, Nov, Dec
My Wife: Jan, Feb, April, Jul, Oct, Dec

Can anyone answer my questions, Thank you very much.
