UK Visitor visa rejected - Advise please

Hello everyone,

My wife is pregnant and due to some medical reasons,I applied for visitor visa for my mother-in-law in 21/04/16 to provide some support for my wife in the initial months of her pregnancy. My mother-in-law travelled to the UK on the 25/04/16 (this was her first visit to the UK) and returned to India on the 9/9/16. Her visa expired on the 20/10/16. Since my wife is due in this month, we applied again for a visior visa on the 21/10/16. But her visa has been rejected for the below reasons.

"You previously entered the UK on the 25 April 2016 and stayed in the UK until 9 September 2016. You now intend to stay in the UK for a further six month period from 8 November 2016. You will therefore spend a combined period of approx 10 months out of the 12 month period in the UK. In view of this I am not satisfied that you would not make the UK your main home and therefore your application has been refused under paragraph V 4.2(b)"

"In light of all the above, I am not satisfied as to your intentions in wishing to travel to the UK now. I am not satisfied that you genuinely intend a short visit only to the UK, that you will not live in the UK for extended periods through frequent or successive visits or make the UK your main home, that you are genuinely seeing enrty for a purpose that is permitted by the visitor routes that you will not undertake any prohibited activities set out in V4.5-410 or that you will have suffucuent funds available to cover your costs whilst in the UK without working or accessing public funds. Your application has therefore been refused under paragraphs V4.2"


Even if she would have got this visa, the plan was that she will return to India on the 30/01/17. I even blocked her a ticket before her visa result and have an email from the travel agency showing the return date of 30/01/2017. In the last few years, my mother-in-law has travelled to Australia on a visitor visa for 3-4 times. Her intentions were never to make UK her main home as my father-in-law is in India and doing agriculture.

Our plan is to re-apply again attaching the email from the travel agency and giving some more proof to prove that she will return and has no intentions to make UK her main home and that she will return on the 30/01/2017.

Any thoughts on whether re-applying with the above is of any use or will the second application also be rejected?

It would be prudent to wait a few months before re-applying.

Spending 10 months of the year in the UK is a lot. The visitor visa is not for residing in the UK.

You made the decision to bring MiL for 'pregnancy support' for a few months and now you are surprised that UKVI refused the visa so soon for another visa and irrespective of how short the visit will be, MiL can't be here for the birth. Applying again will be pointless. Anyone can change air tickets to another date.

As suggested, you will need to wait a few months before trying again for a visa. The refusal will be on record now too so plan it properly

Knowing that the visitor visa might/would be rejected, I had to re-apply visitor visa for my MiL on insistence of my wife and other family members and it was rejected the second time for the same reason. The second application was rejected on the 7-Nov 2016.

Based on experience, can someone please advice how long do we have to wait before we can re-apply visitor visa for my MiL??

I think you'll struggle to ever get one now, visit visas are getting harder to get precisely for this reason.

You don't seem to understand that you have tried to apply for both visas too soon after MIL spent almost 6 months here already.

You were advised to wait a few months before applying, not a few weeks. MIL now has to refusals to her name.

wait for at least 1 year. still chances r slim as she has 2 refusals now.
