American spouse

Post by randall » Mon Nov 14, 2016 6:13 pm

Hi can anyone suggest who we contact regarding my sons wife, she is an American citizen who has been refused entry to the Uk , stopped at Dublin as she was told she overstayed on her last visit .
She was told six months visa and a date to return but only verbally , when trying to return August 2016 was told no record of this and should have been 90 days !
So they have been married six months and unable to be together.
So we now want her to come and live here in Uk but unsure how to go about it with a refused entry on her passport another option is we are prepared to all, go live in Ireland if this is the best option .
Any thoughts or advice from anyone much appreciated , thanks

Visit visas (or implicit visas for visafree nationals) are not for residing on in UK they are for visiting. And visitor has to go home.

Suggest apply for visa before travelling.

What is son's nationality/immigration status in UK?

Hi, my son is British , uk citizen but we want his wife to live here not a visit but feel she will not be allowed to even enter due to her being refused entry in the summer so don't even know what to do next , we are willing to pay but I dont think the home office will let her enter ? Apparently she can apply to visit on a visa but will cost £1, 300 but can still be refused and no refund. :(

To live here, she needs to apply for a UK spouse visa. Your son has to prove he can accommodate her and prove that he earns a minimum of £18,600pa or has substantial savings held for 6 months.

This visa costs £1,195 plus she has to pay £600 immigration health surcharge on top of that.
Apparently she can apply to visit on a visa but will cost £1, 300 but can still be refused and no refund.
There is no UK visitor visa that costs this much, unless perhaps a 10 year visit visa but this doesn't allow her to live here.

Any visa application that is made and refused the fee is lost. UKVI do not refund application fees.
