Further leave to remain somebody help

Post by Welshmale60 » Mon Nov 14, 2016 11:32 pm

Hi all and thanks for taking the time to read this.

I am a male Age 44 my wife is thai aged 40 and our daughter is 7 years old the time as come around for the first further leave to reamain I'm not sure what I'm doing I'm looking at this application and my head is going to explode ,,,,

The scenario I work part time earning only 6000 pa my wife works pt earning 8000 pa
I get child tax and working tax credit of £126 per week and £82 per month child benefit

By the looks of what I've read I've got to go down the 10 year route

I work for the local council on a yearly contract ( wich I just had notice of job ending March 31 2017 due to waiting for funding 99% going to come.

My wife is working part time as a cook with a permanent job (1 year)she gets a docket every week (but gets paid in cash)

Theres a few things worrying me terribly
1 as far as I can see the form says you need dockets for my wife relating to bank statement wich I can't get as she is paid in cash.

2 my job ( 1 year service) is maybe ending in March due to funding (but very unlikely)

My wife does not want to go back to Thailand especially without my daughter hence if I don't get this further leave to remain we will be split up as a family

We both work pay council tax, living in my mothers 2nd home rent free due to us caring for her as I recently lost my father

Also they are asking for my contract from work when I submit it will probably say ending in March 2017

But I am thinking of giving up working part of my hours and only working 1 day a week and being a full time career for my mother anybody needs any information or can assist me in any way I would be very grateful

Many thanks in advance

Carl

If you are a full time carer and get a certain level of carers allowance, this might make you exempt from the financial requirement. Wait for others to advise.

You cannot use your wifes' wages if they are not reflected wholly in a bank statement.

FLR(FP) partner route will be the only option if you cannot meet the financial requirement from income.

Bear in mind that she also has to pay the £500 immigration health surcharge on top of the visa application fee.

Thanks for the reply I know about the £500 healthcare charge but only recently when i originally done the spouse visa that rule wasn't in but now it as been added. another I think for the original visa she had to do a cefr English test b1 would she have to do the new a2 in speaking and listening in English or would the b1 test cover that but they are crafty that test only last 2 years and they give the spouse visa wich initially last 2and half years with the option to extend for another 2 and half years its feeling like its getting more difficult with every page I fill In thanks in advance

B1 should be sufficient.

This is my scenario I work 15 x 8.64 =129.60 I take home £508 per month I payed through bank with bacs
My wife(Thai national) works 16 hours per week @10 per hour and brings home 159.40 with a docket and gets paid in cash

I also get £126 per week in working tax credits

I care for my mother over 35 hours a week but cannot get carers allowance because I earn over £110 per week

My father have recently passed away

My daughter is 7 year old who was born in Thailand but got British nationality

I live in my mothers second house free of charge (no rent) but pay gas, electric, council tax all on my name

Wich if any would be the best way for me and my wife to apply for flr

I'm thinking of giving up work and looking after my mother on a full time basis however if my wife isn't granted a visa I wouldn't be able to do that as my wife is looking after my daughter when I'm caring for my mother (sleeping up my mothers)

We have been married since 2013 we have been in a relationship since 2007

I had 4 holiday visas before 2012

May 2014 spouse visa granted

Now I don't fulfill the financial requirements could I apply down the 10 year route on exempional circumstances or would I be better finishing work and going down the route of carers allowance and finishing work

Makes me think the 2 of us are working and there's a probability that they will deport my partner and split this family up surely there are human rights issues here

Any advice please

Many regards Carl
