T2G immediately after ICT long term

Hi There,

I am on ICT long term visa(3 years) and my wife is on ICT long term dependent(3 years). We both got a job offer here in UK by the same sponsor. But I suppose I can not accept the proposal as I need to serve 12 months cooling off period. So what we found as an alternative is- let my wife apply for T2G and then i would apply as her dependent. I hope this make sense. This make me arrive to following question.
Q1: Could my wife convert the ICT long term dependent visa into T2G? Should it be a fresh application for T2G or some other switch visa?
Q2: if yes then how should she proceed? Should it be require to apply from home country or UK?
Q3: What documents should she require from UK employer as a part of visa requirement?
Q4: Can I then convert my ICT long term to T2G dependent visa on my wife? Should it be a fresh application for T2G dependent or some other switch visa?
Q5: if yes, then how should I proceed..? Should it be require to apply from home country or UK? I
Q6: Can T2G dependent work here in UK?

She cannot covert. It is a new application and she has to apply from home country. Sponsor will have to complete the full and proper RLMT process to prove she is not 'pre-selected'. She has to maintain funds, pay the visa fee and the immigration health surcharge. Is her job on the shortage occupation list? Is her salary in excess of £155K?

Read the guidance. RLMT is key before they can issue a CoS.

Yes. Fresh application once she is granted a visa and is back in the UK. You can switch within the UK. You have to maintain funds, pay the visa fee and the immigration health surcharge.

Yes, but not as a doctor or dentist in training.

Thay is so elaborative.

Rather than maintaining fund, we can ask maintenance letter from employer. Right?

Also regarding #4- it must be some restriction on applying from UK becuase i will be on ICT from other employer. So i need to go back to home country and resign from old employer and then apply for T2G dependent from home country. Could it be possible?

Yes. I think it is only A rated sponsor that can do this but not 100% sure.

No, there is no restriction on apply within the UK. Makes no difference where you apply but you can switch within the UK. Why can't you resign from employer while in the UK?? You don't even have to resign. You can apply for the PBS dependent visa and then inform your employer of your changed visa status.

Thanks CR001,

I cannot just inform my current employer regarding the change of my visa status. They won't like it becuase i am on ICT for current employer and T2G dependent would be for different employer. Current employer paid a lot of money on my ICT visa and transition so if I change my visa here and resign here then they would charge me the whole cost.

Hi Team,
My wife will apply for T2G visa if she gets the job finallised in UK. She has cleared the ILETs exam. I will then apply for T2G dependent because i have also got the job.
Is it require to take ILETS for T2 general dependent visa?

On the employment contract, employers generally mandate employees to disclose visa switches. Please check on the same.
Not really an immigration issue
Any suggestions I make in the forum are out my personal experience and should not be taken as a legal/professional advise.

Just one last one- my ICT visa is till 2020 but my secondment contract is till 2017 and i got to go back to my home country. Can my ICT dependents stays and works here in UK till 2020?

No, their status is wholly dependent on you as the main ICT visa holder being in the UK.
