Tier 2 ICT to Tier 2 General dependant

Post by LSTSB » Sat Nov 26, 2016 3:24 am

Hello team,
I have a rather peculiar and specific case, for which I've had no joy searching for a solution so far. I'm highly hopeful and request that you please advise me on the same.

I work for a company in the UK under tier 2 ICT, and recently my wife has joined the same company under the dependant visa she holds attached to my visa. Is it possible for her to move to tier 2 general, although with the same sponsor, and then for me to apply as her dependant? Are there any specific complications to watch out for, and if this is even possible, is there a cool off period attached in any way, and also can this be processed while in the UK or would we have to travel to our home country?

Thanks in advance.

Yes it is possible, provided the employer has completed the full and proper RLMT process to ensure she has not been 'pre-selected' for the job over a candidate who is British/EU or settled.

She would have to apply from home country. Once she is back, if visa is approved, you can switch within the UK to dependent visa.

Cooling off period does not apply to dependents applying for Tier 2 G main applicant visa.
