Hello All,

I have a British passport and intend to marry my better half in India in Feb. The plan is to take 3 months sabbatical and fly to India in the last week of Dec to plan for the wedding in Feb. Idea is to apply for her visa in 1st or 2nd week of Feb so that we can get a response by last week of March and hopefully if all goes well - I can fly back with her on the same flight. My annual pay is above 50k per annum and have all of my last 12 months pay slip.

However, my big question is this:

Since I will be on sabbatical for 3 months I probably will get £0.00 in my pay slip for these three months and in other words I have NO payslip for . I have been told that my payslips should be in the last 6 months and the most recent one should not be 28 days older - does that mean that we should apply for her visa in Jan or can we still apply for the visa in 1st/2nd week of Feb provided I get a letter from my employer confirming that I'm on sabbatical and returning to work on xxx - Do you think this will work?

It is mandatory to submit the most recent 6 months payslips and bank statements immediately prior to date of visa application. The most recent payslip and bank statement cannot be older than 28 days prior to date of application.

You can only apply for the visa for your future spouse once you are married.

You will have to rely on CAT B if you are going on such long sabbatical.You will need to show the payslips even though it will show 0.00. Employer will need to confirm you are earning a rate of 18600 a year.

I like this idea - thanks Obie - will continue my research on CAT B!

It is a complex matter , giving the time you will be out of work . Further move the evidence of your pay on consideration, will not show that if you multiply that rate by 12, you will be earning the income threshold , as your gross at time of submission will be £0.00 and if multiply by 12, it will be £0.00.

There are 2 side to CAT B.

I know you can meet one. However to meet the second, you will at least need to show 1 payslip as proof you will be earning a rate consistent with the income threshold overy a year.

I think I should meet the second too...
I have been in full-time employment with my present employer since Nov-2015 with pay well in excess of required £18.6k. In other words: all my pay slips from Jan-16 through to Dec-2016 will show the exact same amount: total of these will most certainly be well over £18.6k.

Even if we compute Feb-2016 to Jan-2017 (where Jan-2016 is £0.00 due to unpaid leave) - I'm still sure that the total of these months will be well over £18.6k

But I'm still scared if that will matter to the case officer.... :|

I accept 1st Limb of CaTB will be met, but I am not convince the second limb will be met. If you have been earning 0.00 in the 2 months leading to application, it will be tough.

If you were working in India, it would have been ok, of you showed that you will get work within 3 months of returning to the UK. But this is not the case.

Actually - My sabbatical will be over by the tail end of March - I have a "Sabbatical confirmation letter" from my current employer that I will be returning to work on 15th March 2017 - so in theory & practice I will be back to my work place immediately after I come back to UK. (I wasn't planning to work in Delhi though)
