Tier 4 partner (separated) applying for Tier 2 visa

Hi,

I came to UK as Tier 4 partner in December 2014 but my relationship broke-up shortly after. I now want to apply under tier 2 visa route will there be any issue if i fulfill all the requirements.

I have received no communication from my previous partner or home office till to date.

How long have you been with your current partner?

Were you married to previous partner? If yes, has the divorce been finalised?

Have you changed addresses since your relationship broke down?

I am with my british Partner around 13 months. I never married to my previous partner and applied as Unmarried Partner dependent. I had no communication with home office

If HO don't have the correct address for you, there is no way that you would have received a letter.

Your ex partner had an obligation to inform HO that the relationship broke down and your visa would have been curtailed.

Should be ok to apply for Tier 2 provided your employer completes the full and proper RLMT process to prove to HO that you have not been 'pre-selected'. HO might question the relationship and your current visa status, they might not.

Assuming you have not been curtailed and moving from tier 4 dependent- remember it would have to be a restricted COS.
